What Is A Bond Forfeiture? Can I Get Out If I Have One? When a defendant who has posted a personal or surety bond is supposed to appear in court but fails to do so, the bond is forfeited El Don Bail Bonds. The county will file a lawsuit against the bail bondsman if a surety bond is used. The bail bondsman will make an effort to arrest the offender and save the client the required bail bond fee.
